I think the boy had faster reflexes, and managed to sit on the forward bar. The whole episode must have been a nightmare to the skier, and I hope he gets a settlement.

We had an "incident" and subsequent discussion at my house when someone left the seat up, and my wife expected the seat to be down when she sat at night in the dark. Needless to say I did not win the "you should always check before sitting down" argument, and I will never ever leave the seat up, unless to signal a desire to be single again...
